REGULATION OF THE MINISTER OF AGRICULTURE OF THE REPUBLIC OF INDONESIA NUMBER 17 OF 2025 REGARDING AMENDMENT TO THE REGULATION OF THE MINISTER OF AGRICULTURE NUMBER 29 OF 2021 CONCERNING THE NAMING AND REGISTRATION OF PLANT VARIETIES (PERMENTAN 17/2025)
SUMARRY:
- PERMENTAN 17/2025 was enacted to align with the evolving strategic environment and to enhance the quality of public services related to the naming and registration of plant varieties. This regulation revises Minister of Agriculture Regulation Number 29 of 2021 (PERMENTAN 29/2021).
- PERMENTAN 17/2025 modifies and adds several provisions to PERMENTAN 29/2021.
- Article 4 clarifies the criteria for naming plant varieties. A variety name must reflect the identity of a local variety or a result of plant breeding. It must not use personal names, natural geographic names, national symbols, or registered trademarks. The name is limited to 30 characters and may not consist solely of numbers, punctuation, or generic terms such as “variety” or “hybrid.”
- Articles 7, 9, 11, and 18 reinforce the procedural requirements for registering local varieties and bred varieties. Registration requires geographic data, a scientific description of the variety by a qualified expert, and visual documentation. The application must be submitted by a regional government official according to jurisdiction and must be processed within 17 business days; otherwise, the application is deemed approved by default.
- Articles 12A and 20 establish mechanisms for field verification and DNA testing in the event of uncertainty regarding the varietal description. These steps are mandatory prior to the issuance of the registration certificate and apply to both local and bred varieties. DNA testing shall be conducted by the applicant with the approval of the Plant Variety Protection and Agricultural Licensing Center (Pusat PVTPP).
- A new Chapter IIIA, comprising Articles 23A–23G, introduces the following provisions
1. Data correction may be made free of charge if the error was not attributable to the applicant.
2. Registration may be revoked if false information was submitted or if the rights were granted to another party.
3. Cancellation may be effected if requested by the rightful third party, by the registrant, variety is no longer available.
- Decisions on revocation or cancellation must be publicly announced.
- Article 25A permits manual submission of registration applications in the event of force majeure.
- Article 30A grants the registrant the right to request an English version of the registration certificate.
OTHER PROVISIONS:
- PERMENTAN 17/2025 was enacted on 30 June 2025.
- PERMENTAN 17/2025 shall became effective upon promulgation.
- PERMENTAN 17/2025 was promulgated on 3 July 2025.
- Upon the effective date of this regulation, PERMENTAN 29/2021 shall remain in force.
