CIRCULAR LETTER OF THE FINANCIAL SERVICES AUTHORITY OF THE REPUBLIC OF INDONESIANUMBER 16/SEOJK.07/2025 CONCERNING IMPLEMENTATION OF THE ANTI-MONEY LAUNDERING, COUNTER TERRORIST FINANCING, AND COUNTER-PROLIFERATION FINANCING OF WEAPONS OF MASS DESTRUCTION PROGRAMS FOR DIGITAL FINANCIAL ASSET TRADERS (SEOJK 16/2025)

SUMMARY:

  • SEOJK 16/2025 is promulgated to provide further regulation concerning procedures, reporting mechanisms, and execution of the Anti-Money Laundering (AML), Counter-Terrorist Financing (CTF), and Counter-Proliferation Financing of Weapons of Mass Destruction (CPF-WMD) programs for Digital Financial Asset Traders. This measure is implemented in connection with the enactment of Financial Services Authority Regulation (POJK) Number 27 of 2024 on the Organization of Digital Financial Asset Trading Including Crypto Assets (POJK 27/2024), and in order to execute the provisions under POJK Number 8 of 2023 on the Implementation of AML, CTF, and CPF-WMD Programs within the Financial Services Sector (POJK 8/2023).
  • SEOJK 16/2025 stipulates the following matters:
    1. Implementation of Risk-Based Approach (RBA) to AML, CTF, and CPF-WMD programs.
    2. Active oversight by the board of directors and board of commissioners.
    3. Policies and procedures for AML, CTF, and CPF-WMD programs.
    4. Internal controls.
    5. Management information systems.
    6. Human resources and training.
    7. Reporting obligations to the Financial Services Authority (OJK), including program implementation reports (AML, CTF, and CPF-WMD), immediate blocking reports concerning individuals/entities listed on the List of Suspected Terrorists and Terrorist Organizations (DTTOT) and/or List of Financing for the Proliferation of Weapons of Mass Destruction (DPPSPM), nil reports related to such listings, reports to the Indonesian Financial Transaction Reports and Analysis Center (PPATK), and reports to the Indonesian National Police.
    8. Action plans and procedural policies.
    9. Traders are mandated to ensure that any supporting professionals engaged have implemented AML, CTF, and CPF-WMD programs, are duly registered with the PPATK system, and cooperate with law enforcement and relevant regulatory authorities.

OTHER PROVISIONS:

  • SEOJK 16/2025 shall take effect as of the date of its enactment.
  • SEOJK 16/2025 was enacted on July 3, 2025.
